Four tips on how to write a good law essay.

An essay is a common type of assessment in a law degree. This resource offers tips and resources to help you plan and write law essays. There are usually two types of law essays: the theoretical based essay and the problem-style essay.

The theoretical based essay may ask you to critically discuss a new piece of legislation or a recent case in relation to existing laws or legal principles. You may also be asked to take a side in an argument or discuss the wider societal implications of a legal outcome.

Problem-style essays require you to advise a party based on the analysis of a scenario or given problem. You will be required to identify the legal issues and apply relevant law. There are a number of strategies that may help you in starting, structuring and presenting a law essay.

1. Starting your answer

The first step to a successful law essay is understanding the question. One of the most effective ways of breaking down the question is to identify the direction, content, and scope or limiting words.

For example, look at the following essay question:

Direction Words : Critically analyse.

Content Words: tort of negligence; tort of battery; consenting to medical treatment; patient’s right (autonomous decision).

Scope/Limiting Words: the extent to which, protect.

  • In this case, we need to critically analyse an area of law.
  • Here, we need to research the torts of negligence and battery and the issues of consent in medical treatments and patients’ rights .
  • Here we should critically analyse how well (the extent to which) the aforementioned torts do or do not protect patients’ rights in the context of medical consent .

2. Planning your argument

When reading a case, journal article, book chapter or online article, it can be hard to know exactly how to use the source in an essay. This is where taking good notes while reading critically is helpful. Take a look at our other resources to help you Read critically and Read difficult material .

The next step is to take notes that help you understand different arguments and issues, or information and context, and refer back to your assignment question to keep you on track.

Writing a very short summary of each source is a great way to start. For example, for each journal article you read, try to summarise the author's main points in a few lines. This will help you to articulate the meaning in your own words.

Then, expand on this summary with some key points. Be sure that when taking notes, you make a note of the source and the pinpoint reference or page number, so that you can correctly cite the source in your essay.

Planning strategies

Understanding arguments.

Think about how you will use your resources. You may use a primary or secondary resource to:

  • to support your argument with evidence
  • to demonstrate a range of issues and opinions (remember, it’s OK if you don’t agree with all your sources! Show where these contrasting arguments fit into your discussion)

It may be helpful to ask:

  • How does this source contribute to my argument?
  • Do I agree or disagree with the author’s argument?

Integrating resources into your essay

It is important to use your research well. One way to do this is to plan the main points of your essay, and how you will use your primary and secondary resources (such as journal articles, books, case law, legislation, websites) to support one or more of those points.

3. Structuring your answer

A key element of successful law essays is the structure. A good structure will enable you to communicate your ideas fluently and efficiently. This is an important and highly valued skill not only in law school, but in practice as well.

Usually, your essay requires an introduction, body paragraphs and a conclusion. Generally, you should have one idea per paragraph. This may mean shorter paragraphs than what you would ordinarily write in high school or other faculties. Concision is key in law. Therefore, we recommend a short paragraph which efficiently addresses an issue over a long and winding exploration of many different issues.

Remember to use subheadings to provide structure to your writing. It is a good idea to come up with your subheadings before you start writing so that you have a structure to follow. The subheadings should act as a series of subtopics which reflect the arguments needed to substantiate your thesis statement.

Below we have an overview of the working components of good law essays. Examiners expect you to use all of these in your writing. The samples come from Julie Cassidy, ‘Hollow Avowals of Human Rights Protection: Time for an Australian Federal Bill of Rights?’ (2008) 13 Deakin Law Review 131.

NB: This is an illustrative example only. It is not concise enough for an undergraduate research essay and you would be expected to remove phrases like “In the course of, it is suggested that, in regard to.”

4. Presenting your ideas

In order to do well, you must also present your essay so that it reflects academic standards. This includes correct citation practices, subheadings, Plain English, and grammar and spelling.

Examiners highly value closely edited and proofed work. First-year students commonly rely too much on passive constructions and embellished language. Good lawyers write in clear and concise English that is easily understood.

Your essay must adhere to the AGLC4 rules , including appropriate pinpoint footnotes and bibliography.

Law essays use subheadings frequently, but judiciously. This may be different to what you are used to.

Subheadings also help provide a structure. See the previous section for more advice.

In accordance with AGLC 4, the first word of your heading must be capitalised.

Examiners do not want to see the full extent of your vocabulary. They prefer to see complex arguments rendered in simple language.

This, surprisingly, is not easy. We tend to think through writing. That is, our ideas come to us as we are writing. This leaves a lot of writing which is repetitive, vague, or contradictory as our ideas evolve.

Use the editing worksheet to learn which words you can easily swap out to improve readability and strategies to avoid long-winded constructions.

Do not leave your assignment to the last minute. Not only will this create undue stress, but you will not have adequate time to proofread your assignment.

When we work intensively on a piece of writing, we need a period of time away, or distance, in order to re-read our work objectively. Give yourself 2-3 days before the due date so you can print your text and edit it carefully to remove any typos or grammatical errors.

How to Structure & Write A First-Class Law Essay: Key Tips

Writing a law essay can be a challenging task. As a law student, you’ll be expected to analyse complex legal issues and apply legal principles to real-world scenarios. At the same time, you’ll need to be able to communicate your ideas clearly and persuasively. In this article, we’ll cover some top tips to guide you through the process of planning, researching, structuring and writing a first-class law essay. By the end of this article, you’ll be better equipped to tackle your next writing assignment with confidence!

1. Start In Advance

Give yourself plenty of time to plan, research and write your law essay. Always aim to start your law essay as soon as you have the question. Leaving it until the last minute does not only create unnecessary stress, but it also leaves you insufficient time to write, reference and perfect your work.

2. Understand The Question

Do not begin until you fully comprehend the question. Take the time to read the question carefully and make sure that you understand what it’s asking you to do. Highlight key terms and annotate the question with definitions of key concepts and any questions that you have have. Think about how the question links back to what you’ve learned during your lectures or through your readings.

3. Conduct Thorough Research

Conducting thorough research around your topic is one of the most fundamental parts of the essay writing process. You should aim to use a range of relevant sources, such as cases, academic articles, books and any other legal materials. Ensure that the information you collect is taken from relevant, reliable and up to date sources. Use primary over secondary material as much as possible.

Avoid using outdated laws and obscure blog posts as sources of information. Always aim to choose authoritative sources from experts within the field, such as academics, politicians, lawyers and judges. Using high-quality and authoritative sources and demonstrating profound and critical insight into your topic are what will earn you top marks.

4. write a detailed plan.

Once you’ve done your research, it’s time to plan your essay. When writing your plan, you’ll need to create an outline that clearly identifies the main points that you wish to make throughout your article. Try to write down what you wish to achieve in each paragraph, what concepts you want to discuss and arguments you want to make.

Your outline should be organised in a clear, coherent and logical manner to ensure that the person grading your essay can follow your line of thought and arguments easily.  You may also wish to include headings and subheadings to structure your essay effectively This makes it easier when it comes to writing the essay as starting without a plan can get messy. The essay must answer the question and nothing but the question so ensure all of your points relate to it.

5. Write A Compelling Introduction

A great introduction should, firstly, outline the research topic.  The introduction is one of the most crucial parts of the law essay as it sets the tone for the rest of the paper. It should capture the readers attention and provide the background context on the topic. Most importantly, it should state the thesis of your essay.

When writing your introduction, avoid simply repeating the given question. Secondly, create a road map for the reader, letting them know how the essay will approach the question. Your introduction must be concise. The main body of the essay is where you will go into detail.

6. Include A Strong Thesis Statement

Your thesis should clearly set out the argument you are going to be making throughout your essay and should normally go in the introduction. Your thesis should adopt a clear stance rather than being overly general or wishy-washy. To obtain the best grades, you’ll need to show a unique perspective based upon a critical analysis of the topic rather than adopting the most obvious point of view.

Once you’ve conducted your research and had a chance to reflect on your topic, ask yourself whether you can prove your argument within the given word count or whether you would need to adopt a more modest position for your paper. Always have a clear idea of what your thesis statement is before you begin writing the content of your essay. 

7. Present the Counter-argument

To demonstrate your deeper understanding of the topic, it’s important to show your ability to consider the counter-arguments and address them in a careful and reasoned manner. When presenting your counterarguments, aim to depict them in the best possible light, aiming to be fair and reasonable before moving on to your rebuttal. To ensure that your essay is convincing, you will need to have a strong rebuttal that explains why your argument is stronger and more persuasive. This will demonstrate your capacity for critical analysis, showing the reader that you have carefully considered differing perspectives before coming to a well-supported conclusion.

8. End With A Strong Conclusion

Your conclusion is your opportunity to summarise the key points made throughout your essay and to restate the thesis statement in a clear and concise manner.  Avoid simply repeating what has already been mentioned in the body of the essay. For top grades, you should use the conclusion as an opportunity to provide critical reflection and analysis on the topic. You may also wish to share any further insights or recommendations into alternative avenues to consider or implications for further research that could add value to the topic. 

9. Review The Content Of Your Essay

Make sure you factor in time to edit the content of your essay.  Once you’ve finished your first draft, come back to it the next day. Re-read your essay with a critical perspective. Do your arguments make sense? Do your paragraphs flow in a logical manner? You may also consider asking someone to read your paper and give you critical feedback. They may be able to add another perspective you haven’t considered or suggest another research paper that could add value to your essay. 

10. Proofread For Grammatical Mistakes

Once you’re happy with the content of your essay, the last step is to thoroughly proofread your essay for any grammatical errors. Ensure that you take time to ensure that there are no grammar, spelling or punctuation errors as these can be one of the easiest ways to lose marks. You can ask anyone to proofread your paper, as they would not necessarily need to have a legal background – just strong grammar and spelling skills! 

11. Check Submission Guidelines

Before submitting, ensure that your paper conforms with the style, referencing and presentation guidelines set out by your university. This includes the correct font, font size and line spacing as well as elements such as page numbers, table of content etc. Referencing is also incredibly important as you’ll need to make sure that you are following the correct referencing system chosen by your university. Check your university’s guidelines about what the word count is and whether you need to include your student identification number in your essay as well. Be thorough and don’t lose marks for minor reasons!

12. Use Legal Terms Accurately

Always make sure that you are using legal terms accurately throughout your essay. Check an authoritative resource if you are unsure of any definitions. While being sophisticated is great, legal jargon if not used correctly or appropriately can weaken your essay. Aim to be concise and to stick to the point. Don’t use ten words when only two will do.

12. Create a Vocabulary Bank

One recurring piece of advice from seasoned law students is to take note of phrases from books and articles, key definitions or concepts and even quotes from your professors. When it comes to writing your law essay, you will have a whole range of ideas and vocabulary that will help you to develop your understanding and thoughts on a given topic. This will make writing your law essay even easier!

13. Finally, Take Care of Yourself

Last but certainly not least, looking after your health can improve your attitude towards writing your law essay your coursework in general. Sleep, eat, drink and exercise appropriately. Take regular breaks and try not to stress. Do not forget to enjoy writing the essay!

Concision is a key issue that requires attention in a law essay. Every point you introduce requires to be supported by authorities. It can be a statute or a case law. Pay attention to the structure and type of law essay you are writing, such as compare and contrast, critical analysis, argumentative, and descriptive. 

Pay attention to the key features of a law essay

A law essay focuses on legal issues which can be both current and historical. You can compare and contrast the application of justice in the past and modern society. Introduction

Mostly, the body of a law essay consists of three or four paragraphs. It is the main part of the essay and covers the key arguments. A good body paragraph structure covers three main sections. It starts with the main sentence, which introduces the key argument. The middle part contains the supporting information to the point. You may include relevant minor points to provide greater weight to the main point. The final section is the concluding sentence which crowns the entire paragraph. It is also the transition sentence into the next paragraph and point. 

The conclusion is the last paragraph of your law essay. It reaffirms your points in the body and the thesis statement. Provide a summary of your main point in this section. You may provide a suggestion about what might need further research but avoid introducing a new point. 

Issues to pay attention to

A good essay structure should be simple and easy to follow. Stay within the academic writing guidelines and language. Make sure every source used is referenced based on the citation style of law essays. Use phrases such as it is possible that …, this question deals with…, and it can be argued that …

Writing a law essay is different from writing a case file. You are required to demonstrate your understanding of the law in your araguments. Each argument should be systematically and logically developed. Keep the structure neat, coherent, and effective. With the right information, it should not be difficult thing to write a law essay. What is required from you is a high level of creativity and thinking outside the box.

Tips from your Tutor: How to Write the Perfect Law Essay Introduction

After reading the first few sentences of a law essay, most markers will start to formulate an idea of the mark range. If they start with a Credit, Pass or Fail mark in mind, it becomes incredibly difficult for the paragraphs that follow to bring the paper back up into the higher mark brackets. Impress your marker from the get-go by following these tips…

1. Provide context

You may be keen to begin outlining your points in the first sentence of your essay, but it’s good practice to open your paper with one to three sentences of background information that provides context for the argument that follows. For example:

In 2009, the […..] Act was introduced to remedy problems of […..] However, from its inception it has been criticised for [.....].

2. Refer to the question

It’s good to have some brief background information in your introduction, but this is worthless if it is not related back to the question. Make sure you clearly refer to the question in your introduction by using its key terms throughout. For example, if the question is: “What has been the impact of the […] amendments?” you could refer to the question in the following way:

This essay will examine recent amendments to the [.....] Act and explore their effect upon […..].

3. Be specific

Be specific about where your essay will go. Which reforms or mechanisms will you focus on? Which one(s) will you avoid? Why? Will you draw on any comparative jurisdictions? Theories?

This essay will examine the effectiveness of civil litigation rules in relation to Summary Judgments only. Summary judgments have been chosen as the key area of inquiry because they are the major mechanism a judge can use to filter out cases that should not go to trial. This essay will draw upon the American experience to suggest that a higher threshold test is preferable to NSW’s current standard…

4. Provide a roadmap

After you outline the scope of your argument, you should provide a brief outline of your essay’s structure to assist the reader:

In section I, this essay will outline the key recommendations of the […..] Report. Section II will examine the implementation of these recommendations in the current [……] Amendment Act. In section III, the effectiveness of this amending instrument will be critiqued, before possibilities for reform outlined in Section IV.

5. Finish with your conclusion(s)

Students are often quite shy about putting their conclusion(s) into their introduction, but this comes across as polished and professional:

This essay will ultimately conclude that the threshold test for obtaining a default judgment is inappropriate and unfair, and should be raised to reflect the standard in [jurisdiction].

How to Write a Law Essay

In a college legal studies course, and in some law school courses, you may be required to write a research paper addressing a legal topic. These essays can be tricky, because the law is constantly evolving. To secure a top grade, your essay must be well-researched and coherently argued. With proper planning and research, you can write a stellar legal essay. [Note: this article does not address how to write law school essay exams or bar exam questions, which require different techniques and strategies.]

Choosing an Essay Topic

Step 1 Carefully read the assignment prompt.

  • A narrow essay prompt might read, "Discuss the evolution and impact of the exclusionary rule of evidence in the United States." A broad prompt might read, "Discuss how a civil rights movement led to changes in federal and/or state law."
  • If you are invited to choose your own topic, your professor may require you to submit a written proposal or outline to ensure that your chosen topic complies with the prompt. If you are not sure if your topic is within the parameters of the prompt, propose your topic to your professor after class or during his or her office hours.

Step 2 Read any required materials.

  • Hopefully, your course readings, lectures, and class discussions will have given you enough background knowledge to select a topic. If not, review your class notes and browse online for additional background information.
  • It is not uncommon to change your topic after doing some research. You may end up narrowing the questions your essay will answer, or changing your topic completely.

Step 4 Choose an essay topic of interest to you.

  • If you can, try to focus on an are of the law that affects you. For example, if your family is involved in agriculture, you may be interested in writing about water use regulations .

Researching Your Topic

Step 1 Identify what types of sources you are required to use.

  • If you are prohibited from citing internet resources, you can still use online research to guide you to physical primary and secondary sources in your local library or bookstore.

Step 2 Begin with tertiary sources.

  • Look at footnotes, citations, and indexes in tertiary sources. These are great for finding books, articles, and legal cases that are relevant to your topic. Also take note of the names of authors, who may have written multiple works on your topic.

Step 3 Speak to a librarian.

  • Also find search engines for related fields, such as history or political science. Ask your librarian to recommend specialized search engines tailored to other disciplines that may have contributed to your topic.

Step 5 Gather sources and read them.

  • Never cut and paste from the web into your notes or essay. This often leads to inadvertent plagiarism because students forget what is a quotation and what is paraphrasing. When gathering sources, paraphrase or add quotation marks in your outline.
  • Plagiarism is a serious offense. If you ultimately hope to be a lawyer, an accusation of plagiarism could prevent you from passing the character and fitness review.

Step 7 Look for arguments on both sides of an issue.

  • Provide your own original analysis, explaining to the reader that based on the primary and secondary sources you have presented, the reader should be persuaded by your argument.

A good introduction paragraph is an essential part of any academic essay . It sets up your argument and tells the reader what to expect.

The main goals of an introduction are to:

  • Catch your reader’s attention.
  • Give background on your topic.
  • Present your thesis statement —the central point of your essay.

The invention of Braille was a major turning point in the history of disability. The writing system of raised dots used by visually impaired people was developed by Louis Braille in nineteenth-century France. In a society that did not value disabled people in general, blindness was particularly stigmatized, and lack of access to reading and writing was a significant barrier to social participation. The idea of tactile reading was not entirely new, but existing methods based on sighted systems were difficult to learn and use. As the first writing system designed for blind people’s needs, Braille was a groundbreaking new accessibility tool. It not only provided practical benefits, but also helped change the cultural status of blindness. This essay begins by discussing the situation of blind people in nineteenth-century Europe. It then describes the invention of Braille and the gradual process of its acceptance within blind education. Subsequently, it explores the wide-ranging effects of this invention on blind people’s social and cultural lives.

Your first sentence sets the tone for the whole essay, so spend some time on writing an effective hook.

Avoid long, dense sentences—start with something clear, concise and catchy that will spark your reader’s curiosity.

The hook should lead the reader into your essay, giving a sense of the topic you’re writing about and why it’s interesting. Avoid overly broad claims or plain statements of fact.

Examples: Writing a good hook

Take a look at these examples of weak hooks and learn how to improve them.

  • Braille was an extremely important invention.
  • The invention of Braille was a major turning point in the history of disability.

The first sentence is a dry fact; the second sentence is more interesting, making a bold claim about exactly  why the topic is important.

  • The internet is defined as “a global computer network providing a variety of information and communication facilities.”
  • The spread of the internet has had a world-changing effect, not least on the world of education.

Avoid using a dictionary definition as your hook, especially if it’s an obvious term that everyone knows. The improved example here is still broad, but it gives us a much clearer sense of what the essay will be about.

  • Mary Shelley’s  Frankenstein is a famous book from the nineteenth century.
  • Mary Shelley’s Frankenstein is often read as a crude cautionary tale about the dangers of scientific advancement.

Instead of just stating a fact that the reader already knows, the improved hook here tells us about the mainstream interpretation of the book, implying that this essay will offer a different interpretation.

Next, give your reader the context they need to understand your topic and argument. Depending on the subject of your essay, this might include:

  • Historical, geographical, or social context
  • An outline of the debate you’re addressing
  • A summary of relevant theories or research about the topic
  • Definitions of key terms

The information here should be broad but clearly focused and relevant to your argument. Don’t give too much detail—you can mention points that you will return to later, but save your evidence and interpretation for the main body of the essay.

How much space you need for background depends on your topic and the scope of your essay. In our Braille example, we take a few sentences to introduce the topic and sketch the social context that the essay will address:

Now it’s time to narrow your focus and show exactly what you want to say about the topic. This is your thesis statement —a sentence or two that sums up your overall argument.

This is the most important part of your introduction. A  good thesis isn’t just a statement of fact, but a claim that requires evidence and explanation.

The goal is to clearly convey your own position in a debate or your central point about a topic.

Particularly in longer essays, it’s helpful to end the introduction by signposting what will be covered in each part. Keep it concise and give your reader a clear sense of the direction your argument will take.

In many ways, the invention of the printing press marked the end of the Middle Ages. The medieval period in Europe is often remembered as a time of intellectual and political stagnation. Prior to the Renaissance, the average person had very limited access to books and was unlikely to be literate. The invention of the printing press in the 15th century allowed for much less restricted circulation of information in Europe, paving the way for the Reformation.

This introduction to a literary analysis essay , about Mary Shelley’s Frankenstein , starts by describing a simplistic popular view of the story, and then states how the author will give a more complex analysis of the text’s literary devices.

Mary Shelley’s Frankenstein is often read as a crude cautionary tale. Arguably the first science fiction novel, its plot can be read as a warning about the dangers of scientific advancement unrestrained by ethical considerations. In this reading, and in popular culture representations of the character as a “mad scientist”, Victor Frankenstein represents the callous, arrogant ambition of modern science. However, far from providing a stable image of the character, Shelley uses shifting narrative perspectives to gradually transform our impression of Frankenstein, portraying him in an increasingly negative light as the novel goes on. While he initially appears to be a naive but sympathetic idealist, after the creature’s narrative Frankenstein begins to resemble—even in his own telling—the thoughtlessly cruel figure the creature represents him as.

The introduction is the most important part of your essay, and it has one purpose to fulfill above all others: to draw in the reader. Ideally this should begin right from the attention-grabbing opening sentence. The introduction should then go on to orient the reader to the focus of the essay. But orientation is not an essential purpose because that can be achieved gradually in the essay. Many people make the mistake of writing a paragraph that explains what they’re going to talk about in the rest of the essay.

Such a paragraph might include something like the following:

“My journey toward law has been shaped by a variety of experiences, including academic studies, volunteer work, and extracurricular activities.” The reader knows that you’re going to talk about these things and is most likely muttering to herself, “Get to the point.”

If you have a paragraph like this in your essay, the best move would be to delete it. Often, your second paragraph, which begins to discuss a specific experience, will work much better as an introduction. However, you may also find that a later paragraph works even better. In general, you should bring your most compelling experience to the forefront and then structure your essay around that.

The following is a list of possible approaches to the introduction, with an emphasis on the opening sentence itself:

Jump Right In

Some people will start with a compelling experience but will insist on prefacing that experience with a very generic statement such as the following:

“My interest in law can be traced back to the time I first found out that justice is not absolute.”

Often, the reason people will write such a statement is that they feel compelled to restate the question in some way. If your essay is answering the question “Why are you interested in law?” you should be able to demonstrate your reasons without relying on such a bland summary sentence.

If, on the other hand, you’re tempted to use the first sentence to explain context, you should respect the reader’s intelligence enough to save that context for later. For example, consider the opening sentences from this essay.

“I began hallucinating early Thursday morning. My team and I were halfway finished with what our instructors dubbed ‘The Long Paddle,’ and I could feel my sanity slowly slipping away. A combination of severe sleep deprivation and extreme physical exercise can do that to you.”

This opening is attention grabbing precisely because it offers no context. You’re immediately involved in the story, and you’re curious to see what’s about to happen. If the writer had instead started by explaining that he was in the middle of “Basic Underwater Demolition/SEAL Training,” then the sense of drama would be lost.

Show Your Originality

If you can make yourself stand out right from the first sentence, then you will have contributed a great deal to your case for admission. You should not, of course, just throw out a random fact about yourself; however, if your essay is going to emphasize a unique aspect of your life, then that should come up right away.

This applicant starts as follows:

“I entered boot camp on June 18, 1989. That day, the Indian child who had chased cows and the American youth who had philosophized about physics died.”

By juxtaposing incongruous elements of his personality, the writer highlights his uniqueness and leaves the reader wanting to learn more.

State a Problem

By stating a problem, you create instant curiosity because the reader wants to see how you will address this problem.  This applicant  uses a rhetorical question to state a problem that has confronted him: his height. You don’t need to limit yourself to personal issues, however. You could state a general problem you’ve observed in the legal system and then go on to describe how you hope to address it in your career. You might also cite a discouraging statistic and then reflect on its significance. There are many possibilities here, but what unites them is the element of drama. You should use that to your advantage in creating a strong lead.

This is the type of approach that we can’t ignore because it has the potential to be so effective, but it also could have disastrous results. The same warnings apply here that we enumerated for humor in the Tone section. Try to be subtly and creatively clever rather than outrageous.

This applicant  uses a typical “My interest in law” opening, but has a surprising point to make:

“My interest in the law began with donuts.”

By thwarting expectation with this unconventional origin, the writer succeeds in grabbing the reader’s attention as she turns to a more serious point.

When admissions officers throw you a hardball question, they are rarely seeking a specific “right” answer. Rather, they want to gauge how your mind works, how you respond to a challenge and how you express your interests and values.

Instead of trying to answer a tough question at face value, think carefully about what the interviewer is looking for. Is there a character trait that the question is meant to elicit, like integrity , resilience or quick thinking?

For example, imagine the interviewer asks for your favorite book, but you’re not much of a reader, or your favorite book would sound embarrassing, trite or obscure. Rather than offer a cliché answer like "To Kill a Mockingbird," think of another book you enjoyed that would communicate thoughtfulness or empathy. Perhaps a great novel from another country could show you are well-rounded and eager to engage with other perspectives. 

What to Do if Stumped by an Interview Question

If an answer to an interview question does not readily come to mind, resist the urge to ramble on, thinking aloud. But don’t take a pass or avoid the question altogether.

Instead, tell the interviewer that it’s a good question and you’ll have to think about it for a second. Rather than search high and low for an answer hidden in the wrinkles of your brain, think to yourself: "What is this interviewer trying to get at?"

If the question is about a time when you worked with someone who you didn’t agree with, and you don’t have an example of this, then think about another time you have had to resolve a disagreement. Or think about a time a coworker took an approach to a problem that was not the way you would have handled it, even if it was not objectionable to you. Either way, you would be showing open-mindedness and communication skills.

If your answer does not address the prompt directly, acknowledge this. You could say something like, “I don’t think I’ve ever confronted that exact situation, thankfully. Do you mind if I tell you about a disagreement I had to handle in a different context?”

Likewise, if a question asks for a leadership experience, and you haven’t taken an active role in any jobs or extracurricular activities , think about more subtle ways to show leadership. For example, think of a time you took initiative or acted courageously , even if you were part of a team. 

Fortunately, unlike job interviewers, law school interviewers are not looking for the absolute best candidate to fill one position. They are looking to build a balanced class of students. There is no need to come across as perfect; just be professional, collegial and committed to law school.

Family Law on the Multistate Essay Exam: Highly Tested Topics and Tips

Family Law is regularly tested on the MEE. Here, we give you an overview of Family Law on the MEE. We will reveal some of the highly tested topics and give you tips for approaching a Family Law MEE question.

Family Law on the Multistate Essay Exam

1. first, be aware of how family law is tested.

Family Law is tested about once a year. Family Law generally is tested on its own. However, occasionally it will appear with a Conflict of Laws issue.

2. Be aware of the highly tested Family Law issues

The examiners tend to test several of the same issues in Family Law MEE questions. You can maximize your score by being aware of these highly tested issues. (We have a nice summary of these in our  MEE One-Sheets  if you want to see all of them and have them all in one place.)

Many commercial bar review courses spend a lot of time on topics that are  not  highly tested (e.g., general requirements of marriage, defenses to fault-based divorce, intra-family tort immunity, marital rape, family privacy, donor eggs, gestational agreements, etc.). As a result, some examinees spend a lot of time on topics that they are unlikely to see on the exam.

We recommend that you focus instead on the highly tested Family Law MEE topics.

Some of the highly tested Family Law Multistate Essay Exam issues include: 

Child custody and support.

Child custody and child support are regularly tested on the MEE. Here are a few subtopics that have been tested:

  • Custody:  custody is determined by looking at the best interests of the child .
  • Child support:   All states employ numerical guidelines and establish a rebuttable presumption that the award that results from applying the guidelines is correct. The guidelines must be applied in all cases, regardless of the parents’ marital status. The court will look at factors like income and earnings of the parents, the number of children and their ages, and any special needs of the children.
  • Modification:  custody or support can be modified if there is a substantial change in circumstances.

Modification of Child Support When Income Reduced Voluntarily

  • Rights of the biological father:   Biological fathers generally have rights . However, the state may make the biological father exercise his rights within a specific time (e.g., two years).

Property division and alimony

  • Marital vs. separate property:   Marital property is property acquired during the marriage and is subject to division . Separate property includes (mnemonic =  BIG ): property acquired  b efore the marriage, an  i nheritance , or a  g ift to one party. Most states do not count professional degrees earned during the marriage as marital property. Separate property is generally not subject to division.

Approaches to Property Division at Divorce

  • Premarital agreement:  A court will enforce a premarital agreement so long as it is  voluntarily  made,  substantively fair , and if  full disclosure of assets and obligations was made. A court will  not,  however, enforce a premarital agreement regarding  child custody or support if it is not in the  best interest of the child .

Law Governing Enforceability of Premarital Agreements

  • Alimony:   Alimony can be permanent , temporary , or granted in a lump sum . States consider many factors, including the parties’ financial resources and needs , marital contributions , and marital duration . Alimony awards are not final and can be modified if there has been a substantial change in circumstances .

Other Family Law issues

In Family Law MEE questions, both the Uniform Interstate Family Support Act (UIFSA) and the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) generally are applied.

  • The UIFSA governs child support. Once a child support order is registered, it may be enforced by any state. The state that originally issued a child support order has exclusive jurisdiction to modify the order if the state remains the residence of the obligee, the child, or the obligor, and at least one of the parties does not consent to the use of another forum.

  • The UCCJEA governs child custody orders . This statute incorporates various tests. Under the  home state test, the “home state” has exclusive jurisdiction to modify a decree. A home state is a state where the child has lived with a parent or person acting as a parent for at least six consecutive months immediately before the commencement of the child custody proceeding . A home state continues to have exclusive jurisdiction to issue a custody order for six months after a child leaves the state, so long as a parent (or person acting as a parent) still lives in the state. The  significant connections test applies if a child has no home state. Under this test, a state may exercise jurisdiction based on (1) significant connections with the child and at least one parent and (2) the existence of substantial evidence relating to child custody in the forum jurisdiction.

3. Be aware of how certain Family Law topics are tested

Certain Family Law topics tend to be tested in specific ways. For example:

  • Retroactive modification of child support has been tested regularly. If you remember that federal law forbids retroactive modification of child support (absent circumstances like fraud), you will answer this question correctly. The outcome has always been the same on the MEE!
  • When the UCCJEA is tested , generally the Parental Kidnapping Prevention Act (PKPA) is also mentioned. The PKPA is very similar to the UCCJEA, and the result is virtually always the same. However, it does not hurt to mention that “the result would be the same under the PKPA” if you see a UCCJEA issue tested.

These are just some examples of how specific topics are tested. The best way to master these topics is to practice past MEEs!

4. Practice!

Practice is critical if you want to master Family Law on the MEE. You will get exposed to the kinds of issues the examiners like to test as well as how they tend to be tested.

  • July 2021 Family Law MEE: this MEE covers personal jurisdiction, PKPA, UCCJEA, UIFSA.
  • October 2020 Family Law MEE: this MEE covers UIFSA; Reduce child support award when material/substantial change in circumstances; and spousal support modifiable—substantial change in circumstances (alimony).
  • July 2020 Family Law MEE: this MEE covers a state may grant divorce if person is domiciled; state may grant custody even if no PJ over other respondent parent; state may not grant property because need PJ over respondent; fault basis may be established for divorce; and best interest of the child factors.

With Israel declaring war on the Gaza Strip after an unprecedented attack by the armed Palestinian group Hamas on Saturday, the world’s eyes are again sharply focused on what might come next.

Hamas fighters have killed more than 800 Israelis in assaults on multiple towns in southern Israel. In response, Israel has launched a bombing campaign in the Gaza Strip, killing more than 500 Palestinians. It has mobilised troops along the Gaza border, apparently in preparation for a ground attack. And on Monday, it announced a “total blockade” of the Gaza Strip, stopping the supply of food, fuel and other essential commodities to the already besieged enclave in an act that under international law amounts to a war crime.

But what unfolds in the coming days and weeks has its seed in history.

For decades, Western media outlets, academics, military experts and world leaders have described the Israeli-Palestinian conflict as intractable, complicated and deadlocked.

Here’s a simple guide to break down one of the world’s longest-running conflicts:

What was the Balfour Declaration?

  • More than 100 years ago, on November 2, 1917, Britain’s then-foreign secretary, Arthur Balfour, wrote a letter addressed to Lionel Walter Rothschild, a figurehead of the British Jewish community.
  • The letter was short – just 67 words – but its contents had a seismic effect on Palestine that is still felt to this day.
  • It committed the British government to “the establishment in Palestine of a national home for the Jewish people” and to facilitating “the achievement of this object”. The letter is known as the Balfour Declaration .
  • In essence, a European power promised the Zionist movement a country where Palestinian Arab natives made up more than 90 percent of the population.
  • A British Mandate was created in 1923 and lasted until 1948. During that period, the British facilitated mass Jewish immigration – many of the new residents were fleeing Nazism in Europe – and they also faced protests and strikes. Palestinians were alarmed by their country’s changing demographics and British confiscation of their lands to be handed over to Jewish settlers.

What happened during the 1930s?

  • Escalating tensions eventually led to the Arab Revolt, which lasted from 1936 to 1939.
  • In April 1936, the newly formed Arab National Committee called on Palestinians to launch a general strike, withhold tax payments and boycott Jewish products to protest British colonialism and growing Jewish immigration.
  • The six-month strike was brutally repressed by the British, who launched a mass arrest campaign and carried out punitive home demolitions , a practice that Israel continues to implement against Palestinians today.
  • The second phase of the revolt began in late 1937 and was led by the Palestinian peasant   resistance movement, which targeted British forces and colonialism.
  • By the second half of 1939, Britain had massed 30,000 troops in Palestine. Villages were bombed by air, curfews imposed, homes demolished, and administrative detentions and summary killings were widespread.
  • In tandem, the British collaborated with the Jewish settler community and formed armed groups and a British-led “counterinsurgency force” of Jewish fighters named the Special Night Squads.
  • Within the Yishuv, the pre-state settler community, arms were secretly imported and weapons factories established to expand the Haganah, the Jewish paramilitary that later became the core of the Israeli army.
  • In those three years of revolt, 5,000 Palestinians were killed, 15,000 to 20,000 were wounded and 5,600 were imprisoned.

The first Intifada 1987-1993

  • The first Palestinian Intifada erupted in the Gaza Strip in December 1987 after four Palestinians were killed when an Israeli truck collided with two vans carrying Palestinian workers.
  • Protests spread rapidly to the West Bank with young Palestinians throwing stones at Israeli army tanks and soldiers.
  • It also led to the establishment of the Hamas movement, an off-shoot of the Muslim Brotherhood that engaged in armed resistance against the Israeli occupation.
  • The Israeli army’s heavy-handed response was encapsulated by the “Break their Bones” policy advocated by then-Defence Minister Yitzhak Rabin. It included summary killings, closures of universities, deportations of activists and destruction of homes.

  • According to the Israeli human rights organisation B’Tselem, 1,070 Palestinians were killed by Israeli forces during the Intifada, including 237 children. More than 175,000 Palestinians were arrested.
  • The Intifada also prompted the international community to search for a solution to the conflict.

The Oslo years and the Palestinian Authority

  • The Intifada ended with the signing of the Oslo Accords in 1993 and the formation of the Palestinian Authority (PA), an interim government that was granted limited self-rule in pockets of the occupied West Bank and Gaza Strip.
  • The PLO recognised Israel on the basis of a two-state solution and effectively signed agreements that gave Israel control of 60 percent of the West Bank, and much of the territory’s land and water resources.
  • The PA was supposed to make way for the first elected Palestinian government running an independent state in the West Bank and Gaza Strip with its capital in East Jerusalem, but that has never happened.
  • Critics of the PA view it as a corrupt subcontractor to the Israeli occupation that collaborates closely with the Israeli military in clamping down on dissent and political activism against Israel.
  • In 1995, Israel built an electronic fence and concrete wall around the Gaza Strip, snapping interactions between the split Palestinian territories.

The second Intifada

  • The second Intifada began on September 28, 2000, when Likud opposition leader Ariel Sharon made a provocative visit to the Al-Aqsa Mosque compound with thousands of security forces deployed in and around the Old City of Jerusalem.
  • Clashes between Palestinian protesters and Israeli forces killed five Palestinians and injured 200 over two days.
  • The incident sparked a widespread armed uprising. During the Intifada, Israel caused unprecedented damage to the Palestinian economy and infrastructure.
  • Israel reoccupied areas governed by the Palestinian Authority and began construction of a separation wall that along with rampant settlement construction, destroyed Palestinian livelihoods and communities.
  • Settlements are illegal under international law, but over the years, hundreds of thousands of Jewish settlers have moved to colonies built on stolen Palestinian land. The space for Palestinians is shrinking as settler-only roads and infrastructure slice up the occupied West Bank, forcing Palestinian cities and towns into bantustans, the isolated enclaves for Black South Africans that the country’s former apartheid regime created.
  • At the time the Oslo Accords were signed, just over 110,000 Jewish settlers lived in the West Bank, including East Jerusalem. Today, the figure is more than 700,000 living on more than 100,000 hectares (390sq miles) of land expropriated from the Palestinians.

The Palestinian division and the Gaza blockade

  • PLO leader Yasser Arafat died in 2004, and a year later, the second Intifada ended, Israeli settlements in the Gaza Strip were dismantled, and Israeli soldiers and 9,000 settlers left the enclave.
  • A year later, Palestinians voted in a general election for the first time.
  • Hamas won a majority. However, a Fatah-Hamas civil war broke out, lasting for months, resulting in the deaths of hundreds of Palestinians.
